Lonsdaleite Capital (“Lonsdaleite,” “we,” “us”) provides transactional funding for real estate double closings. This Privacy Policy explains what information we collect through this website and in the course of evaluating and funding a transaction, how we use and share it, and the choices you have.
Scope
This policy applies to information collected through this website, through the forms on it, and through communications with our funding desk about a transaction or a partnership. It does not apply to the practices of title companies, closing attorneys, lenders or other third parties involved in your transaction, each of which has its own privacy practices.
Information we collect
Information you provide
- Contact and business details: your name, company or firm, role, email address and phone number.
- Transaction details: the property state, A–B purchase price, B–C sale price, target closing date, the title company or closing attorney on the file, and any notes you include.
- Documents: purchase contracts and related closing documents you choose to upload or send us. These may contain personal information about other parties to the transaction, such as sellers and end buyers.
- Partner details: for title companies and closing attorneys, the states you close in, your closing volume, and your closing and wire instructions.
- Correspondence: the content of messages you send us.
Information collected automatically
When you visit the site, our hosting provider records standard server logs, which may include your IP address, browser type, device type, the pages you request and the time of the request. This site does not use advertising or analytics cookies. See our Cookie Policy for details.
Information from other sources
In the course of underwriting a transaction we may receive information from the title company or closing attorney on the file, from public property records, and from services used to verify identity, ownership or funds.
How we use information
- To evaluate, underwrite, approve and fund transactions, and to issue proof of funds to the closing desk on a file.
- To onboard and work with partner title companies and closing attorneys, including holding their closing and wire instructions.
- To respond to inquiries and communicate about a transaction, a partnership or our services.
- To prevent fraud, verify identities and funds, and protect the security of our business, our partners and the parties to a transaction.
- To comply with legal obligations, including record-keeping, and to establish or defend legal claims.
- To operate, secure and improve this website.
We do not use your information for third-party advertising, and we do not sell personal information.
How we share information
- Parties to the closing. We share what is needed to close with the title company or closing attorney handling the file. Your contract price on the A–B leg is not disclosed to your end buyer.
- Service providers. We use vendors for hosting, email, document storage, e-signature, identity and funds verification, and similar services. They may process information only on our instructions and under confidentiality obligations.
- Professional advisers. Our attorneys, accountants, auditors and insurers, where necessary.
- Legal and safety. When required by law, subpoena or court order, or when we believe disclosure is necessary to protect the rights, property or safety of Lonsdaleite, our partners or others, including to prevent fraud.
- Business transfers. In connection with a merger, acquisition, financing or sale of all or part of our business, subject to this policy.
Retention
We keep transaction records for as long as needed to service the transaction and to meet our legal, regulatory, tax and accounting obligations, and for the period during which claims could arise. Inquiries that do not lead to a transaction are kept only as long as reasonably necessary to respond and maintain our records. When information is no longer needed we delete it or render it anonymous.
Security
We use administrative, technical and physical safeguards appropriate to the sensitivity of the information we hold, including encrypted connections to this website, access controls and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Never send bank account or wire details through an unverified channel; wire instructions are confirmed directly with the closing desk.
Your choices and rights
You may ask us to access, correct or delete the personal information we hold about you, or to stop contacting you, by reaching the funding desk through the contact form. We will respond within the time required by applicable law and may need to verify your identity before acting on a request. We may keep information we are required to retain.
Depending on where you live, you may have additional rights under state privacy laws, including the right to know what personal information we have collected, to request deletion, to correct inaccurate information, and not to be discriminated against for exercising these rights. Where those laws apply we honor them, and you may designate an authorized agent to act on your behalf.
Children
This site and our services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18.
Third-party sites
This site may link to sites we do not control. Their privacy practices are their own, and this policy does not apply to them.
